Welcome to Class Cabs ("Company," "we," "our," "us"). These Terms and Conditions govern your use of our website, mobile application, and school transport safety services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services.

By using our Services, you represent and warrant that:

• Age: You are at least 18 years of age. If you are under 18, you may use our Services only with the involvement of a parent or guardian.
• Authority: If you are using our Services on behalf of a school or organization, you have the legal authority to bind that entity to these Terms.
• Accuracy: All information you provide is accurate, current, and complete.
• Compliance: Your use of our Services complies with all applicable laws and regulations in India.

Class Cabs provides a comprehensive school transport safety platform including:

• Real-time GPS Tracking: Live location tracking of school vehicles.
• Live CCTV Monitoring: Streaming video from inside school buses.
• Speed Governor Alerts: Real-time notifications when vehicles exceed speed limits.
• Driver Verification: Background checks and verification services.
• Child-Check Protocol: Digital attendance and anti-sleeping child detection.
• Emergency SOS: Instant emergency alerts and medical response coordination.

5.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use

5.2 Account Types

• Parent Account: Access to child's journey tracking, live CCTV, and alerts
• School Admin Account: Access to fleet management, driver monitoring, and compliance reports
• Driver Account: Limited access for route navigation and check-in/out protocols
• Transport Provider Account: Access to vehicle management and driver oversight

5.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

Your privacy is critically important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6.1 Child Data Protection

We comply with all applicable laws regarding children's data, including:

• We collect only necessary information for safety purposes
• Parental consent is obtained before collecting child data
• Child data is never sold or shared with third parties for marketing
• Location data is encrypted and access is restricted

6.2 Data Retention

We retain user data for as long as necessary to provide Services and comply with legal obligations. Location data is retained for 30 days for safety review purposes.

7.1 Subscription Fees

Certain Services require payment of subscription fees. Fees are:

• Charged in advance on monthly or annual basis
• Non-refundable except as required by law
• Subject to change with 30 days' notice

7.2 Payment Methods

We accept various payment methods including credit cards, debit cards, UPI, and bank transfers. You authorize us to charge your chosen payment method for all fees incurred.

7.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No partial refunds are provided.

Schools using Class Cabs agree to:

• Driver Verification: Ensure all drivers undergo mandatory police verification and medical fitness tests
• Vehicle Compliance: Ensure vehicles meet safety standards (speed governors, grills, first aid kits, fire extinguishers)
• Parent Notification: Inform parents about the use of monitoring technology
• Emergency Protocols: Maintain and practice emergency response procedures
• Data Accuracy: Keep child and parent information updated
• Compliance: Adhere to all applicable laws including Motor Vehicles Act and CBSE guidelines

Drivers registered on our platform agree to:

• Maintain valid driving licenses and permits
• Complete mandatory background verification
• Undergo regular medical and psychometric tests
• Follow all traffic rules and speed limits
• Complete child safety training provided by Class Cabs
• Perform daily vehicle safety checks
• Use the Class Cabs app as required (check-in/out, route adherence)
• Report any incidents immediately

Parents using Class Cabs agree to:

• Provide accurate emergency contact information
• Update child's medical information promptly
• Ensure children are ready at pickup points on time
• Designate authorized persons for pickup and drop-off
• Respond to alerts and notifications appropriately
• Report any concerns about driver behavior or vehicle safety

All content, features, and functionality of our Services, including but not limited to:

• Software, algorithms, and code
• Designs, graphics, and user interface
• Text, images, and videos
• Trademarks, logos, and brand elements
• Patents and proprietary technology

are owned by Class Cabs and protected by Indian and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our express written consent.

You agree not to:

• Use the Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Tamper with GPS trackers or CCTV cameras
• Provide false information during registration
• Share account credentials with unauthorized users
• Use the Services to harass, abuse, or harm others
• Reverse engineer any aspect of our technology

To the maximum extent permitted by law:

• Class Cabs provides Services "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for Services in the past 12 months
• We are not responsible for acts of God, accidents, or events beyond our control
• We do not guarantee that Services will be uninterrupted or error-free

Specifically regarding school transport safety: While we provide monitoring and alert systems, we cannot guarantee that all incidents will be prevented. Class Cabs is not liable for:

• Accidents caused by driver negligence
• Third-party actions
• Vehicle mechanical failures
• Delays in emergency response

You agree to indemnify, defend, and hold harmless Class Cabs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit

We reserve the right to:

• Modify, suspend, or discontinue any part of our Services
• Update these Terms from time to time
• Change fees with reasonable notice

We will notify you of material changes via email or through the app. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be resolved through:

1. Negotiation: Parties will attempt to resolve disputes through good-faith negotiations
2. Mediation: If negotiation fails, disputes will be referred to mediation in Noida, Uttar Pradesh
3. Jurisdiction: Courts in Noida, Uttar Pradesh have exclusive jurisdiction

In case of emergencies:

• SOS Alerts: Our system automatically notifies schools and emergency contacts
• Medical Information: Authorized personnel can access child's medical profile
• Coordination: We coordinate with emergency services but are not responsible for their response times

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any additional agreements you may enter into with Class Cabs, constitute the entire agreement between you and Class Cabs regarding your use of our Services.
